TERMS AND CONDITIONS

1. Forms of payment:

At M.S Kitchens & Wardrobes, we offer 3 types of payment methods to choose from;

Option A (suitable for higher value orders);

After an agreements has been made on cost estimate a deposit of 30% of the total order value is required at the time when we call in to your house to measure your job. We will then present you 3d design project to be accepted within a few days from collecting the deposit.


A second payment of 50% of the total order value is required after an agreements has been made on the details of your 3d design project to initiate the processing of your order, we can now start making carcases and we are ready to purchase select materials that we do not stock e.g. doors, worktops, appliances, or sliderobe doors that are custom order only.
Upon satisfactory completion of the customer’s order, we require that the remainder of the payment owed be made upon the day of completion. You will also be asked to complete our Declaration of Customer Satisfaction form to confirm that you’re 100% satisfied and the completed work meets your expectations.

Option B (suitable for higher value orders);

After an agreements has been made on cost estimate a deposit of 50% of the total order value is required at the time when we call in to your house to measure your job to initiate the processing of your order. We will then present you 3d design project to be accepted within a few days from collecting the deposit.

A second payment of 30% of the total order value is required after we have finished processing your order to the state that carcases have been made and we are ready to purchase select materials that we do not stock e.g. doors, worktops, appliances, or sliderobe doors that are custom order only.
Upon satisfactory completion of the customer’s order, we require that the remainder of the payment owed be made upon the day of completion. You will also be asked to complete our Declaration of Customer Satisfaction form to confirm that you’re 100% satisfied and the completed work meets your expectations.

Option C (suits lesser and higher value orders);

A deposit of 80% of the total order value is an option whereupon we can start processing your order without delay. We will then present you 3d design project to be accepted within a few days from collecting the deposit.

This option usually reduces completion time for your custom wardrobes by up to one week and reduces completion time by up 1.5 week in the case of kitchens. Upon the day that we complete your order and after making sure that you’re completely satisfied with the finished product, we require the remaining part of the payment to be completed. You will be also asked to complete our Declaration of Customer Satisfaction form to confirm that you’re 100% satisfied and the completed job meets your expectations.

We normally don’t require that the total amount of the order is paid before the job has been fully completed. Customers wishing to do so may choose to pay in full. Payment in full will substantially reduce completion time to between 1 and up to 2 weeks in the case of wardrobes and other less time-consuming jobs.

2. REALIZATION TIME:

For all wardrobes and smaller less complicated jobs, the realization time is normally up to 3 weeks from the date of receiving the payment deposit provided that the customer has completed the second payment in the case of using payment option A.
However, we aim to have these jobs completed in about 2 weeks so that you can start enjoying your new furniture as soon as possible.

For smaller kitchens or other jobs of medium level of difficulty, the turnaround time is up to 4 weeks from the date of receiving the deposit, provided that the customer has completed the second payment instalment in the case of using payment option A.
We aim to have these jobs completed in approximately 3 weeks, so that you may start enjoying your new furniture and fill your kitchen cupboards as soon as possible.

We reserve the right to change the realization time accompanied by notifying the customer of any delay; 
In the case of processing more complicated products
In the case of our supplier’s failure to timely deliver materials required to finish processing customer’s orders, or in the case of complete failure of our supplier’s order, or in the case of our supplier’s delivery being incomplete/incorrect/damaged. 
If the customer fails to punctually fulfil the second payment upon using payment option A.
Other unforeseen causes at the time of completing the terms and conditions that may force us to change the realization time.
In any of the cases listed above, we will immediately contact the customer without delay to inform of any changes in realization time that may impact upon fitting date where fitting is required in relation to the customer’s order.

3. Understanding the order details

We, the company, will provide advice to the best of our ability and we will try to explain all aspects relating to the order that we feel our customers should be informed about that may impact upon the realization time and other factors mentioned in our terms and conditions. Most relative questions are explained when visiting our showroom. Our showroom display fitted furniture contains very good examples of the expected quality of our finished goods and samples of fittings we may use.
Should you require any extra information or explanations regarding any of our products, please don’t hesitate to ask questions.

Please acknowledge that we do not accept any responsibility for any complications resulting from customer’s errors/omissions. In the event of human error on the customer’s behalf, we will consult with you and attempt to assist you to rectify the issue(s) within reason.
For any error(s) occurring on behalf of the company, we the company will take full responsibility.
Please ensure that you fully understand all of the main aspects of your order, payment options and the terms and conditions related 
to your order, so that we can complete your order without delay and without complications.

4. Cancelling your order

You, the customer, have the right to cancel your order by written application only if;
 
- We have NOT processed your order to the state that we have carcases made
- Materials have NOT been bought specifically to complete your order
- We, the company, are not able to offer you the same or a product of similar specification to the product that you've ordered

If the conditions listed above have all been met, your deposit will be returned to you minus a cancellation fee of €150 to cover processing of 3D computer design and/or any other expenses related to processing your order that you may wish to cancel.


Cancelling your order in cases when:

- We have processed your order to the state when we have carcases made or
When materials have been bought to process your order.

Please note that cancelling your order in the case when the above conditions have occurred is still possible, but depends on the possibility that we can cancel any purchases that we have made in relation to your order.

If we can’t cancel any or part of the purchase, the customer will be responsible for covering the cost, after which the purchased items will be released to you and will become your property. 
The customer will be also responsible for covering the cancellation fee of €150 and our expenses related to delivery/collection of any purchased materials.

5. Changing your order;

As a customer, you have the right to change your order provided that:

- changes didn’t occur due to fault on the customer’s behalf
- changes will not impact upon the order value, in particular they will not exceed the value of the original order
- we have NOT yet processed your order to the state that we have carcases made and/or materials have NOT been purchased to complete your order
- items to complete the customer’s order haven’t yet been ordered

If the changes impact upon the product value:

Any additional cost of these changes must be covered by the customer
If the changes required are less than the total order value, the difference will be deducted from the total order value

Changing your order in the case when:

- Changes are due to customer error
- We have processed your order to the state that we have made carcases or
  materials have been purchased to construct carcases.
- Custom order items have been ordered.

If changes generate any extra expenses to the company, these will also have to be paid for by the customer regardless whether changes reduce or increase the total value of your order.

If the changes occur on behalf of our company’s fault, we usually cover the cost of these changes. Alternatively, we may offer you the option to cancel your order. All of the aforementioned may be discussed with the customer and the outcome may be decided upon by the company in conjunction with the customer.

6. Product availability:

If we, the company, are unable to offer you the customer the product which you have chosen, we will offer a product of similar specifications to meet your expectations.

Please note that you will be also given the choice to either cancel your purchase and receive a full deposit return, or agree to the specified changes of the product to complete your order.
If unavailability of a product has occurred due to misinformation on behalf of our supplier(s), processing the cancellation of your order may take longer to process, so please be patient.

If unavailability of the product occurs due to a fault on behalf of our company, we may offer you a discount. You also won’t be responsible to cover cancellation fees or any of our expenses related to your order. 

7. Terms and conditions related to online purchases:

7.1 Forms of payments

In the case of online purchases, only one form of payment is accepted at the moment, which is bank transfer.

7.2 Realization time

For all wardrobes and smaller less complicated jobs, the realization time is normally up to 3 weeks from the date of receiving the deposit provided that the customer has completed the second payment in the case of using payment option A.
However, we aim to have these jobs completed in approximately 2 weeks so  that you can enjoy your new furniture as soon as possible.

- higher complication level products ordered
- our supplier’s failure to deliver materials required to finish processing customer’s orders 
- if our supplier’s order hasn’t been delivered, is delivered incomplete/damaged or not according to our order list request
- if the customer fails to fulfil the second payment using payment option A.

Other unforeseen circumstances we are not aware of at the time of completing the terms and conditions may arise that may force us to change the realization time.
In any of the cases above, we will contact the customer without delay to inform of any changes in realization time as it may impact upon arranging a fitting date if fitting is required in relation to customer’s order.

7.3 Understanding order details

We, the company, will provide helpful advice to the best of our ability and will try to explain all aspects related to the order that we feel our customer should be informed of that may impact upon realization time and other factors mentioned in our terms and conditions. However, most related questions are often explained when visiting our showroom as the display fitted furniture contain very good examples of the quality and samples of fittings we use.

In the case that we the company are not able to offer you the customer the product you have chosen, we will attempt to introduce to you to a product of similar specification that in our opinion will meet your expectations.

Please note that you will be also be given the choice to either cancel your purchase and have your deposit returned in full, or alternatively you may agree to specified changes to the product to complete your order.
If unavailability of the product occurs due to misinformation on behalf of our supplier, processing of the cancellation of your order may take additional time, so please be patient.

If unavailability of the product occurs due to our company’s fault, we may offer you a discount. The customer shall not be responsible to cover the cancellation fee or any of our expenses related to your order. 

8. We the company reserve all rights to change our terms and conditions any time in the future, notification of which will be stated and highlighted in the terms and conditions before point no.1 forms of payment.
